Collins and Collins v. Waggoner

Waggoner sued Collins and Collins for trespass in Madison County Circuit Court who found in favor of Waggoner. Waggoner cited an earlier case in the Justice of the Peace involving Constable McMahon in his replication of this case. Collins appealed to the Supreme Court stating Waggoner's replication was in error by mentioning Constable McMahon in his replication and not in his declaration. The Supreme Court reversed the Circuit Court's decision stating that if the replication departs from the declation, it is in error.



Foley v. People

Foley was Indicted by the The People for larceny in a special term of the Madison County Circuit Court. The Circuit Court found in favor of The People. Foley appealed to the Supreme Court to answer if the Circuit Court had jurisdiction in this case. The Supreme Court answered: "the court below.. had no jursidiction, no legal existance, and thus was no court".



Mason v. Wash

Wash sued Mason for a Breech of Contract at the Madison County Circuit Court. The Circuit Court ruled for Wash. Mason appealed to the Supreme Court who reversed the judgement and remanded the cause for new proceedings.
